The www.endurancemotive.com website is the property of Endurance Motive, S.A. and complies with the requirements of Law 34/2002, of 11th July, on Services. of the information society and electronic commerce, as well as the regulations in force on the protection of personal data, and in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2006 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data.

Endurance Motive, S.A. reserves the right to modify or adapt this privacy policy at any time. We therefore recommend that you check this every time you access the website. If you are a user and have registered on the site, you will be informed in the event of any substantial changes to the processing of your personal data.

Who is the data controller?

The data that is collected or voluntarily provided to us through the website, either by browsing it or by providing it to us, as well as any data that may be provided in contact forms, by e-mail or by telephone, will be collected and processed by the manager of the file, whose contact details are indicated below:

When, why, who, how, for what and for how long do we process your personal data?

When and why?

You can browse most of our websites without having to provide personal information, but in some cases this information is necessary to provide you with the electronic services you request from us.

If we need to collect personal data in order to provide the service to you, we will process such data in the following manner in accordance with the policy set out in this document and in the relevant service-specific policy (if applicable), containing specific privacy statements on the use of the data and informing you of why, for what, how, for how long we process your personal data, and the security measures we implement.

Who collects your data?

The collection and processing of personal data that you may provide us with, are carried out by our entity or, where applicable, by its subcontractors. In the latter case, these persons are third parties who are contractually bound to ensure that their activity complies with the law and implement appropriate safeguards to protect this data.

What is the purpose of this?

The personal data that we request from you, or that you provide to us as a result of your browsing, is used to manage, provide and improve the services that you have requested from us.

How do we process your data?

We only collect personal information to the extent that it is necessary to achieve a specific purpose. The information will not be used for a purpose incompatible with that described.

We will only disclose information to third parties if it is deemed essential to comply with the rules of the service purpose and only to those who need to know it. We only keep data for as long as is necessary to achieve the purpose of the collection or further processing. The length of data retention depends on the service and, for each service, the duration of the personal data processing procedure.

For what purposes will we process your personal data?

  • The customers:

We process your personal data for the purpose of (i) managing your purchase or service (ii) maintain the contractual and pre-contractual relationship for invoicing, budgeting and monitoring and sending information electronically about your application; (iii) sending communications about commercial information electronically that may be of interest to you, provided that there is express permission; (iv) we may develop a commercial profile based on the information you provide so that we can offer you products and services based on your interests. We will not make automated decisions based on this profile.

  • Suppliers:

We process your personal data for (i) invoicing and (ii) maintaining commercial contact, (iii) as well as sending information electronically about our products or services.

  • Contacts on the Web or by e-mail:

We process your personal data for the purposes of (i) responding to your requests and (ii) (ii) manage the service requested or process your order; (iii) send you commercial information by electronic means that may be of interest to you, (iv) we can develop a company profile on the basis of the information that you provide in order to offer you products and services according to your interests. No automated decisions will be made on the basis of this profile.

  • Social network contacts:

We process your personal data in order to (i) answer your questions and (ii) provide you with the best possible service. (ii) to manage the service requested, respond to your request or process your and (iii) interact with you and create a community.

  • Jobseekers:

We process your personal data for the purpose of (i) relying on you in the processes (ii) to invite you to job interviews and to evaluate your application, (iii) to communicate your curriculum vitae to group companies, employees or similar for the sole purpose of involving you in their selection processes, as long as you have given us your consent.

  • Participants in our competitions:

We process your personal data for the purpose of managing your participation in the competitions we organise and to announce the winners of the competition and the award ceremony.

The awarded participants may be photographed or filmed and broadcast in all media, on our website or by other means of communication. Therefore, it is possible that the image of the participants may be captured, recorded and/or reproduced in a way that is incidental to the main activity.

  • Web users:

When you browse our website, we collect information about your browser, device and usage data and any information you provide to us when you use our website. On an anonymous or aggregate basis, we may record the IP address (the device’s Internet access identification number, which allows devices, systems and servers to recognize and communicate with each other).

The purpose of the processing is (i) to obtain practical knowledge about how users use our website that will enable us to improve it; (ii) to carry out statistical analyses that will help us to improve our commercial strategy; (iii) to carry out analyses of the website’s performance and (iv) to carry out technical security and system diagnostics.

The data we obtain is not linked to a specific user and will be stored in our databases.

In order to offer interesting information or services depending on the user’s location, we may access data relating to the geolocation of the user’s device in cases where the user’s configuration for this purpose allows it.

Any personal information collected through these applications may be used by third party users. What is the legitimacy of the processing of your data?

  • The customers:

The legal basis for the processing of your data is (i) the execution of a contract and the maintenance of the contractual relationship and (ii) your consent which is requested for the sending of offers of products and services by electronic means, without the withdrawal of this consent being a condition for the execution of the contract.

  • Suppliers:

The legal basis for the processing of your data is (i) the performance of a contract with which the data subject is associated or for the application of pre-contractual measures.

The legal basis for the processing of your data is (i) the consent of the data subject.

In cases where, in order to make a request, it is necessary to fill in a form and click on the send button, this necessarily implies that you have been informed and that you have expressly given your consent to the content of the clause attached to this form or your acceptance of the privacy policy.
All our forms have a checkbox that must be activated to access the services offered.

The purposes of the processing will be as follows:

a) To manage the consultations or requests for information that you send us via the web page, e-mail or telephone.
b) To send communications, special promotions, news or actions that result from your interest or request, even by electronic means. As this is an objective secondary to the main objective, you must tick the box provided for this purpose.

The personal data you provide us with by this means will not be disclosed to third parties. Endurance Motive, S.A. will respond directly to this type of request.

  • -Social network contacts:

The legal basis for the processing of your data is the acceptance of the contractual relationship with the corresponding social network provider, are expressed by the registration in its application and in accordance with its privacy policies, which is external to us.

  • Work with us:

If you provide us with your curriculum vitae, whether through the web page, by e-mail or physically at your home or at the headquarters of Endurance Motive, S.A., you will be included in our database. The curriculum will be kept for a period of one year, after which it will be deleted in the event that you have not been contacted by us.
The legal basis for the processing will be based on the express consent of the data subject to the processing of the data contained in the curriculum vitae when submitting it and ticking the box provided for this purpose.

The purpose of the processing is to integrate you into the current and future selection processes of Endurance Motive, S.A. or any entity belonging to the group of companies.

In the event that the interested party joins Endurance Motive, S.A. or one of the companies in the group as an employeeyour data will be integrated into a company-owned database, in order to internally manage the employee-employer relationship.

  • Sending of the newsletter:

The website allows you to subscribe to the Endurance Motive, S.A. newsletter. To do so, you must provide us with an e-mail address to which the newsletter will be sent.

This information will be stored in an Endurance Motive, S.A. database where it will be registered until the interested party requests its cancellation or, where applicable, Endurance Motive, S.A. stops sending it.

The legal basis for the processing of this personal data is the express consent given by all interested parties who subscribe to this service by ticking the box provided for this purpose.

The data contained in the e-mails will only be processed and stored for the purpose of managing the sending of the Newsletter by users who request it.

  • Participants in our competitions:

The legal basis for the processing of your data is your consent to register for the competition and to accept the privacy policy and competition rules. The personal data collected will not be passed on to third parties.

  • Users of the web:

The legal basis for data processing is our (i) legitimate interest in knowing how our users navigate in order to adapt us to their interests and improve our relationship with them; and (ii) their consent when they navigate on our website and accept the conditions of use of cookies.

To whom will your data be communicated?

Your data will not be passed on to third parties outside the service we provide, unless required to do so by law. In particular, the National Agency for Tax Administration and Banks and Financial Institutions will be informed about the collection of the service provided or the product purchased.

Your data may also be communicated to our service providers when this is necessary for the performance of the contract. In these cases, the data controller is contractually bound to use the data only for the purpose justifying the processing and to maintain adequate security measures.

What security measures do we apply?

You can be assured that we have adopted adequate technical and organisational measures to guarantee the confidentiality, integrity and availability of the processing of your personal data that we carry out. In particular those that prevent the loss, misuse, alteration, unauthorised access and theft of personal data.

What are your rights when you provide us with your data?

What are your rights when you provide us with your data? You may exercise your rights to access, amend, delete, portray, limit or object to the processing of your data, including the right to withdraw your consent given, as set out below:

Right of access: you can ask us whether we process your data and which data we process way.

Right of modification : You can ask us to update your personal data if they are incorrect, and to delete them if you wish.

Right to limit processing: In this case, we will only keep them for the exercise or defence of rights.

Right to object: Following your request to object to the processing, we will stop processing the data in the manner you have indicated, unless there are compelling legitimate reasons or the exercise or defence of any claims make it necessary to continue processing.

Right to data portability: If you wish your data to be processed by another company, we will provide the portability of your data to the new manager.

Right of deletion: You can ask us to delete your data when it is no longer required for processing, you withdraw your consent, it is unlawful processing or there is a legal obligation to do so. We will analyse the case and apply the law.

If you need more information about your rights under the law and how to exercise them, we recommend that you contact the Spanish Data Protection Agency, which is the data protection supervisory authority.

You can contact the Data Protection Officer before filing a complaint against the data controller with the AEPD.

If we have not ensured that your rights have been exercised, you can file a complaint with the Spanish Data Protection Agency.

We have forms for the exercise of rights which can be requested at the above-mentioned e-mail address; you can also use those prepared by the Spanish Data Protection Agency or those of third parties. These forms must be signed electronically or accompanied by a photocopy of your identity card.

If you are acting through a representative in the same way, you must be accompanied by a copy of your identity card or an electronic signature.

Forms must be delivered in person or sent by post or e-mail to the addresses indicated in the “Responsible” section.

The maximum time limit for a decision is one month from receipt of your application.

How long will we keep your data?

At the end of this period, the personal data processed for each of the purposes indicated will be kept for the periods legally established. If such a legal period does not exist, it will be maintained until the person concerned requests its deletion or revokes the consent given, or for such time as a judge or court may require, taking into account the statute of limitations for legal actions.
